Terms of use

The rules that keep BrainSync useful, fair, and safe for creators, hosts, and participants.

1. Operator and service

BrainSync is operated by Jyoti Ranjan Padhi, an individual developer based in India. BrainSync provides tools for creating, publishing, assigning, hosting, and participating in quizzes, chess challenges, polls, and other interactive activities, both independently and through supported integrations such as Zoom.

2. Eligibility

You must be able to enter a binding agreement in your location. BrainSync is not primarily intended for children under 16. Users under 16 may participate only through a properly managed educational environment and with the authorization required from a school, parent, guardian, or responsible adult.

3. Accounts and security

  • Provide accurate account information and keep it current.
  • Keep credentials confidential and do not share creator accounts.
  • You are responsible for activity conducted through your account unless you promptly report unauthorized access.
  • We may require verification, restrict access, or suspend an account to protect users or the service.

4. Creator and participant responsibilities

Creators control the activities they publish, the people they invite, and the content they collect. Participants are responsible for the answers, display names, reactions, and other material they submit.

You agree not to use BrainSync to harass, impersonate, discriminate, cheat, invade privacy, distribute malware, violate intellectual-property rights, facilitate unlawful conduct, or expose another person’s sensitive information without a valid reason and appropriate permission.

5. User content

You retain ownership of content you create. You grant BrainSync a limited, worldwide license to host, copy, process, display, and transmit that content only as needed to operate, secure, and improve the service. You confirm that you have the rights and permissions needed for anything you upload or publish.

We may restrict or remove content reasonably believed to be illegal, abusive, unsafe, infringing, or harmful to BrainSync or its users. Report objectionable content through Support.

6. Live sessions and scoring

Hosts control session timing, questions, scoring configuration, lobby access, and moderation. Network delays, device performance, and host actions can affect response timing and results. BrainSync results are intended for engagement and learning; they should not be the sole basis for a high-stakes educational, employment, financial, medical, or legal decision.

7. Zoom and third-party services

Zoom, MongoDB Atlas, Amazon Web Services, and other third-party services have separate terms and policies. BrainSync is not Zoom and is not endorsed by Zoom unless explicitly stated by Zoom. Availability of an integration may depend on account permissions, client versions, meeting settings, or the third party’s services.

8. Intellectual property

BrainSync’s software, branding, visual design, and original service content are owned by the operator or licensed contributors. These terms do not transfer those rights. You may not copy, reverse engineer, resell, or misuse the service except where applicable law expressly permits it.

9. Availability and changes

BrainSync may add, change, limit, or discontinue features. We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Planned or urgent maintenance, infrastructure failures, third-party outages, and events outside reasonable control may affect availability.

10. Suspension and termination

You may stop using BrainSync at any time. We may suspend or terminate access for material violations, security threats, unlawful use, prolonged inactivity, or when required by law. Where appropriate, we will provide notice and a reasonable opportunity to correct the issue. Account and Zoom removal instructions are available on the data deletion page.

11. Disclaimers

To the maximum extent permitted by law, BrainSync is provided “as is” and “as available”, without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these terms excludes warranties or rights that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, BrainSync and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of opportunity, or loss of profits arising from use of the service. Any aggregate liability will be limited to the amount paid by the claimant for BrainSync during the twelve months preceding the claim, or INR 5,000 if no payment was made, except where such a limitation is prohibited.

13. Governing law and disputes

These terms are governed by the applicable laws of India, without regard to conflict-of-law rules. Before starting formal proceedings, contact us and allow a reasonable opportunity to resolve the issue informally. Courts with competent jurisdiction in India will hear disputes that cannot be resolved, subject to any mandatory consumer rights.

14. Changes and contact

We may update these terms as the service changes. Continued use after an updated version takes effect constitutes acceptance where permitted by law. Questions can be sent to support@jrpadhi.com.
